These terms govern the use of the Ganoto website and app: accounts, listings, rental requests, payments, security deposits, vehicle handovers and communication between members.
2. Accounts and Requests
Each member provides accurate, current and personal information. He may neither create an account for a third party, nor use an identity, a document, a means of payment or bank details belonging to another person without valid authorization.
Ganoto may request additional verification, suspend an account or limit an action when an inconsistency, usurpation, attempted circumvention or risk of fraud is detected.
3. Rental right
By publishing a vehicle, the owner declares to be its holder or to have sufficient written authorization to rent it. It guarantees that the vehicle is not stolen, rented or borrowed from a third party and that no leasing, rental, fleet, financing or other commitment prohibits subletting.
Ganoto may request the vehicle registration certificate, authorisation from the registered keeper, employer, lessor or leasing company, and any supporting evidence establishing the right to offer the vehicle for rent. A false declaration may result in the immediate suspension of the listing, account, transaction or payout, without prejudice to any report to the competent authorities.
4. Prohibited uses
The lessee cannot sublet, transfer, lend or entrust the vehicle to an unauthorized driver. He cannot sell it, pawn it, dismantle it, modify it, duplicate the keys or documents, change its administrative holder, cancel or replace its registration documents, nor take it out of the authorized area without written agreement.
Also prohibited: off-platform payment requested to circumvent fees or checks, false damage, artificial notices or sponsorships, the use of a stolen means of payment, the publication of the same vehicle under several identities and any attempt to hide the true identity of a party.
5. Security controls and measures
Ganoto can cross-check account, document, vehicle, payment and reservation information; detect duplicates; request enhanced verification; limit high value vehicles; delay a payment; or submit a transaction for manual review.
In the event of serious suspicion, Ganoto may keep the useful elements, temporarily block an account, an ad, a reservation, a payment or a payment and cooperate, in compliance with the law applicable, with the payment provider, the authorities or professionals mandated to deal with the incident.
6. Payment, security deposit and insurance
Payments, security deposits, fees and payouts follow the steps shown in Ganoto and the payment provider's terms. A security deposit is not insurance, a liability limit or a guarantee that any loss will be reimbursed.
Ganoto does not currently provide any insurance or cover for rentals. Nothing displayed, selected or entered in the app constitutes proof of insurance. Any future cover may be treated as active only after separate written confirmation stating the insurer, period of cover, insured risks, exclusions, limits and applicable excess.
7. Documents, delivery and evidence
When verification is required, Ganoto will direct you to the appropriate secure channel or module. Do not send any identity document, driving licence, vehicle registration certificate, banking information or insurance document through the public form.
Before and after the rental, the parties must check the driver's identity, keys, mileage, fuel level or battery charge, vehicle condition and requested photos. Documents and evidence are not displayed publicly; other users receive only the information needed for the application, unless a controlled process is required by law or to handle an incident.
8. Responsibility and Limits of Controls
Each user is responsible for his declarations, his actions, compliance with the rental contract and the consequences of unauthorized use or rental. He must immediately inform Ganoto of any theft, misappropriation, fraud, accident, invalid document or unauthorized access to his account.
Ganoto does not replace either an insurer, an authority, or a physical inspection of the vehicle. Unless otherwise mandatory, Ganoto is not responsible for false information provided by a member, for an act committed outside the platform or for damage resulting from prohibited use that it could not reasonably detect.
9. Terms of Transaction
The price, dates, availability, mileage allowance, security deposit and vehicle-specific rules are those confirmed in the booking summary. Both parties must accept them before any binding booking and comply with any owner restrictions that do not conflict with these terms or the law.
